Read Bob Laszewski comments on the constitution questions of the mandate debate. After you do consider that one of the many reasons the mandate was included in the Health Care Reform law was that insurers need to guarantee issue all of their policies. To fight adverse selection they positioned (correctly) that everyone would need to participate in such a guarantee issue scheme.

If the mandate is deemed unconstitutional then consider the new legal ground that insurer would have to resist the guarantee issue provision.

Well known policy guru Bob Laszewski laments the lack of bipartisan support for health care reform and its potential consequences.
